PURPOSE OF THE UNIT STANDARD 
This Unit Standard would be useful to all people involved in the Auctioneering industry, particularly those involved in the Auctioneering of real estate. It would also be useful for estate agents.

The qualifying learner is capable of:
  • Explaining and describing the purpose and function of the Estate Agents Act (Act no 112 of 1976) and its amendments.
  • Explaining and describing the purpose and function of the Alienation of Land Act (Act no 68 of 1981) and its amendments.
  • Demonstrating an understanding of the conditions of sale for real estate.
  • Explaining the auctioning process for real estate. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    It is assumed that a learner will be competent in:
  • Communication at NQF Level 4.
  • Mathematical Literacy at NQF Level 4. 

  • UNIT STANDARD RANGE 
  • The relevant acts will include the Estate Agents Act no.112 of 1976 and Alienation of Land Act no.68 of 1981.
  • Clauses will include payment required, description of property, transfer of us, transfer of possession, voetstoets, cancellation, breach, nominee, electrical compliance, price, confirmation of price, commission, suspensive and cooling-off clauses.

    The process required before a real estate auction can take place and the process that a real estate auction must follow are explained in terms of the requirements of the legislation.

    Demonstrate an understanding of the conditions of sale for real estate.

    ASSESSMENT CRITERION 1 
    The purpose and nature of a valid mandate is explained in terms of the advantages and disadvantages and legal requirements for both the estate agent and the seller. 

    ASSESSMENT CRITERION 2 
    Suspensive conditions pertaining to real estate auctioning are explained with examples. 

    ASSESSMENT CRITERION 3 
    An absolute one-sided contract is described in terms of legislative regulations. 

    SPECIFIC OUTCOME 3 
    Explain the auctioning process for real estate.

    ASSESSMENT CRITERION 1 
    That the selling of property is explained in terms of "by the rise" and in line with company procedures. 

    ASSESSMENT CRITERION 2 
    The terms "with or without reserve" are explained in line with relevant legislation. 

    ASSESSMENT CRITERION 3 
    Auction conditions are read out in required format and according to company regulations. 

    ASSESSMENT CRITERION 4 
    The term "sold subject to confirmation" is explained in line with legislation. 

    ASSESSMENT CRITERION 5 
    Commission procedure on completion of auction is described in terms of relevant regulations. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • An individual wishing to be assessed against the unit standard (including through Recognition of Prior Learning) may apply to an assessment agency, assessor or provider institution accredited by the relevant Education and Training Quality Assurance body (ETQA), or one with an appropriate Memorandum of Understanding (MOU) with the relevant ETQA.
  • Anyone assessing a learner against this unit standard must be registered as an assessor with the relevant ETQA, or one with an appropriate MOU with the relevant ETQA.
