PURPOSE OF THE UNIT STANDARD 
This unit standard will be useful to those who work or intend to work within the field of Immigration Law Enforcement, and who are required to carry out immigration law enforcement administration.

People credited with this unit standard are capable of:
  • Explain the maintenance of records for immigration law enforcement.
  • Processing financial guarantees for immigration law enforcement purposes.
  • Maintaining statistics related to immigration law enforcement functions. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    The credit calculation is based on the assumption that learners are already familiar with the current Immigration legislation and regulations.
  • Communication Skills NQF Level 4.
  • Mathematical Literacy NQF Level 4.
  • Computer Literacy NQF Level 3. 

  • UNIT STANDARD RANGE 
    Learners will be expected to work with a wide range of people, mainly in the public, as well as with the police, the South African National Defence Force, Non-Government Organisations, National Intelligence Agency and any other law enforcement agency and the business sector. The learner will also be required to interact with the Justice Department.

    Maintain records for immigration law enforcement. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Reasons why case files must be opened for every task of Immigration Law Enforcement, and records must be filed and maintained in a manner that facilitates ease of access for those authorised to access records is explained with examples. 

    ASSESSMENT CRITERION 2 
    Consequences of not keeping documents up to date, complete and accurate are explained with examples. 
    ASSESSMENT CRITERION RANGE 
    Documents to be completed include: investigation diary, notice of rights, detention warrant, extension of detention, release warrant, notice of deportation, order to leave the country, order to report to the Immigration officer for further investigation.
     

    ASSESSMENT CRITERION 3 
    Methods of maintaining registers of files according to national system requirements are analysed to determine best practice. 

    ASSESSMENT CRITERION 4 
    Reasons why the filing index must be available for quick and easy file retrieval by authorised persons are explained with examples. 

    ASSESSMENT CRITERION 5 
    The importance of confidentiality and security requirements are explained in terms of maintenance of records. 

    SPECIFIC OUTCOME 2 
    Process financial guarantees for immigration law enforcement purposes. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Decisions of whether to secure a guarantee or deposit are made in accordance with current sections of the Immigration Act and departmental policy. 

    ASSESSMENT CRITERION 2 
    Analysis of payment registers is conducted in order to verify whether they reflect all payments. 

    ASSESSMENT CRITERION 3 
    Reasons why money must be recorded as received by Finance Section are explained with reference to given Treasury regulations. 

    ASSESSMENT CRITERION 4 
    Cases are assessed on their merits to determine whether guarantees or deposits should be refunded or forfeited in line with current regulations. 

    SPECIFIC OUTCOME 3 
    Maintain statistics related to immigration law enforcement functions. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Categories of statistics are identified in order to maintained them. 
    ASSESSMENT CRITERION RANGE 
    Categories include: investigations conducted and completed, follow-up on complaints received, cases opened, cases referred to the National Prosecuting Authority, arrests, appeals and deportations.
     

    ASSESSMENT CRITERION 2 
    Statistics are used to follow up on outstanding cases and to compile a case profile or trends. 

    ASSESSMENT CRITERION 3 
    Statistics are interpreted in a non-biased manner. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a candidate against this unit standard must be registered as an assessor with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this unit standard must be accredited as a provider through the relevant ETQA by SAQA.
  • Moderation of assessment will be overseen by the relevant ETQA according to the moderation guidelines and the agreed ETQA procedures.
