PURPOSE OF THE UNIT STANDARD 
This unit standard will be useful to people working within the legal framework within which corrections have to operate.

People credited with this unit standard are able to:
  • Demonstrate an understanding of the bigger picture regarding the legal framework within which corrections have to operate.
  • Identify laws applicable to corrections in general.
  • Identify laws and sections of legislation applicable in particular cases or different situations.
  • Consider all sections of legislation applicable in dealing with different particular issues.
  • Take account of amendments to legislation.

    2. The status of amendments with regard to date of enforcement is determined in accordance to the procedures applicable to the creation of legislation.

    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
  • Anyone assessing a candidate against this unit standard must be registered as an assessor with the relevant ETQA.
  • Any institution offering learning that will enable achievement of this unit standard must be accredited as a provider through the relevant ETQA by SAQA.
  • Moderation of assessment will be overseen by the relevant ETQA according to the moderation guidelines and the agreed ETQA procedures. 

  • UNIT STANDARD ESSENTIAL EMBEDDED KNOWLEDGE 
    The following essential embedded knowledge will be assessed through assessment of the specific outcomes in terms of the stipulated assessment criteria:

  • List of applicable legislation
  • Effect of amendments

    Candidates are unlikely to achieve all the specific outcomes, to the standards described in the assessment criteria, without knowledge of the listed embedded knowledge. This means that for the most part, the possession or lack of the knowledge can be directly inferred from the quality of the candidate`s performance. Where direct assessment of knowledge is required, assessment criteria have been included in the body of the unit standard.

Organising and managing in a certain manner could in itself be in conflict with applicable rules or laws, which should be guarded against.

    Note: The collecting of information in terms of applicable rules and provisions or laws. Analysing which particular rules, provisions or laws are applicable in particular cases.     Note: Reflected by the understanding that making choices between particular alternatives cannot be done without ensuring that all related guiding references are taken into account. A piece of legislation cannot be viewed in isolation but has to be considered in relation to other legislation that may be applicable. Further reflected by the understanding that problems can not be solved in isolation but in context of all applicable rules , provisions and or laws. 

    UNIT STANDARD ASSESSOR CRITERIA 
    Assessors should keep the following principles in mind when designing and conducting assessments against this unit standard:
  • Focus the assessment activities in terms of the title.
  • Assessment activities should be as close to the real performance as possible and when simulations are used, there should be supporting evidence to show that the person is able to perform in the real situation
  • Assessment activities should focus on outcomes and should be sufficient to enable evidence to be gathered around all the assessment criteria.
  • The assessment criteria provide the specifications against which assessment judgements should be made. In most cases, knowledge can be inferred from the quality of the performances, but in other cases, knowledge and understanding will have to be tested through questioning techniques. Where this is required, there will be assessment criteria to specify the standard required
  • All assessment should be conducted in line with the following well documented principles of assessment: appropriateness, fairness, manageability, integration into work or learning, validity, direct, authentic, sufficient, systematic, open and consistent.
