PURPOSE OF THE UNIT STANDARD 
The person credited with this unit standard will be able to describe current legislative procedures applicable to the fishing industry. They are also able to describe fishing rights and their application within the industry.

People credited with this unit standard are able to:
  • Identify current legislative and regulatory requirements, and company specific operating procedures applicable to a fishing vessel.
  • Identify current legislative requirements applicable to marine resources.
  • Identify and describe available fishing rights and application evaluation criteria. 

  • LEARNING ASSUMED TO BE IN PLACE AND RECOGNITION OF PRIOR LEARNING 
    The credit calculation is based on the assumption that learners are already competent in terms of the following outcomes or areas of learning when starting to learn towards this unit standard:

    Identify current legislative and regulatory requirements, and company specific operating procedures. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Current legislative and regulatory requirements and company operating procedures are identified in accordance with a vessel's operating certificate. 
    ASSESSMENT CRITERION RANGE 
    Requirements include but are not limited to: the seaman's responsibility to meet ports, health, dangerous goods requirements.
     

    ASSESSMENT CRITERION 2 
    The requirements for company operating procedures are identified in terms of a vessel's operating certificate. 

    ASSESSMENT CRITERION 3 
    Regulatory organisations involved in issuing and monitoring the compliance of a vessel's operating certificate are identified and explained with examples. 
    ASSESSMENT CRITERION RANGE 
    Regulatory organisations include but are not limited to: South African Maritime Safety Authority, STCW, immigration authorities.
     

    ASSESSMENT CRITERION 4 
    The consequences of not adhering to the legislated procedures are identified and described in terms of legal action, delays and administrative problems. 

    ASSESSMENT CRITERION 5 
    Safety equipment required on the vessel is identified in accordance with a vessel's operating certificate. 
    ASSESSMENT CRITERION RANGE 
    Safety equipment includes but is not limited to: personal life preservation equipment, life rafts, life jackets and buoys, electronic aids, radio telephone.
     

    SPECIFIC OUTCOME 2 
    Identify current legislative requirements applicable to marine resources. 
    OUTCOME RANGE 
    Legislation includes but is not limited to: The Marine Living Resources Act. 

    ASSESSMENT CRITERIA
     

    ASSESSMENT CRITERION 1 
    Key papers relating to marine resources are identified and their purpose explained with reference to the implications for the fishing business. 

    ASSESSMENT CRITERION 2 
    Key structures in place to enforce legislation are identified in relation to their role and powers. 
    ASSESSMENT CRITERION RANGE 
    Structures include but are not limited to: Department of Environmental Affairs, observers, Fishery control officers.
     

    ASSESSMENT CRITERION 3 
    The management of South Africa's marine resource are explained with reference to key provisions made under the legislation. 
    ASSESSMENT CRITERION RANGE 
    Provisions include but are not limited to: total allowable catch, priority areas, allocation of fishing rights and conditions for cancellation and suspension, fishing boat licenses, fishing harbours, high seas fishing.
     

    ASSESSMENT CRITERION 4 
    Prohibited activities are identified and explained in terms of the reasons for prohibition, and the penalties attached to non-compliance. 
    ASSESSMENT CRITERION RANGE 
    Prohibitions include but are not limited to: protected areas, closed seasons, fishing methods, illegal gear and gear stowage, illegal changes to gear, drift nets, aggregation of fish, minimum species size, prohibited sales, marine culture and marine plants.
     

    ASSESSMENT CRITERION 5 
    Duty to report irregularities is explained with examples in terms of company policy and the provisions of current legislation. 

    ASSESSMENT CRITERION 6 
    The consequences of not reporting irregularities are explained with examples and include with reference to legal and/or company liabilities. 

    SPECIFIC OUTCOME 3 
    Identify and describe available fishing rights and application evaluation criteria.

    ASSESSMENT CRITERION 1 
    The different fishing right categories are identified and the differences explained in line with Department of Environmental Affairs guidelines. 

    ASSESSMENT CRITERION 2 
    Criteria used in evaluating applications are described and explained in terms of the implications for the applicant. 

    ASSESSMENT CRITERION 3 
    Key factors to be considered when applying for rights are described in relation to the effect on the business. 
    ASSESSMENT CRITERION RANGE 
    Factors include but are not limited to: fee structures, Duration of Rights, Transfer of Rights.
     

    ASSESSMENT CRITERION 4 
    The quota registration and allocation process and procedures are described in line with the policy guidelines from the Department of Environmental Affairs. 


    UNIT STANDARD ACCREDITATION AND MODERATION OPTIONS 
    Providers of learning towards this unit standard will need to meet the accreditation requirements of the relevant ETQA.

    Moderation Option: The moderation requirements of the relevant ETQA must be met in order to award credit to learners for this unit standard. 

    UNIT STANDARD ESSENTIAL EMBEDDED KNOWLEDGE 
    The following essential embedded knowledge will be assessed through assessment of the specific outcomes in terms of the stipulated assessment criteria. Candidates are unlikely to achieve all the specific outcomes, to the standards described in the assessment criteria, without knowledge of the listed embedded knowledge. This means that for the most part, the possession or lack of the knowledge can be directly inferred from the quality of the candidate's performance. Where direct assessment of knowledge is required, assessment criteria have been included in the body of the unit standard.
  • Guidance in correct operation of equipment is provided in The Code of Safe Working Practices for Seamen.
  • Prevention of pollution of the marine environment is governed by regulation, (MARPOL) legislated by the International Maritime Organisation.

    UNIT STANDARD ASSESSOR CRITERIA 
    Assessors should keep the following general principles in mind when designing and conducting assessments against this unit standard:
  • Focus the assessment activities on gathering evidence in terms of the main outcome expressed in the title to ensure assessment is integrated rather than fragmented.
  • Make sure that evidence is gathered across the entire range, wherever it applies. Assessment activities should be as close to the real performance as possible, and where simulations or role-plays are used, there should be supporting evidence to show the candidate is able to perform in the real situation.
  • The assessment criteria provide the specifications against which assessment judgements should be made. In most cases, knowledge can be inferred from the quality of the performances, but in other cases, knowledge and understanding will have to be tested through questioning techniques. Where this is required, there will be assessment criteria to specify the standard required.
  • The task of the assessor is to gather sufficient evidence, of the prescribed type and quality, as specified in this unit standard, that the candidate can achieve the outcomes again and again and again. This means assessors will have to judge how many repeat performances are required before they believe the performance is reproducible.
  • All assessments should be conducted in line with the following well documented principles of assessment: appropriateness, fairness, manageability, integration into work or learning, validity, direct, authentic, sufficient, systematic, open and consistent.

    The following particular issues should be taken into consideration when assessing against this unit standard:
  • All candidates to be assessed for this unit standard are required to provide evidence of competence (obtained by attending an approved course) in the following
    (i) Basic First Aid.
    (ii) Fire Fighting
  • Evidence is required with regard to the candidate being medically fit.
  • The importance of both safety and due care and consideration for the environment is to be kept in mind when assessing a candidate for this unit standard. 

  • REREGISTRATION HISTORY 
    As per the SAQA Board decision/s at that time, this unit standard was Reregistered in 2012; 2015.
